Privacy Policy
Information on the processing of personal data pursuant to art. 13 of Legislative Decree 196/2003 and art. 13 of EU Regulation no. 2016/679.
Pursuant to art. 13 of Legislative Decree 196/2003 (hereinafter “Privacy Code”) and art. 13 of EU Regulation no. 2016/679 (hereinafter “GDPR 2016/679”), containing provisions for the protection of people and other subjects with respect to the processing of personal data, the Municipality of Lacco Ameno protects the confidentiality of personal data and guarantees them the necessary protection from any event that could put them at risk of violation.
Pursuant to EU Regulation 2016/679 (hereinafter GDPR) and in relation to personal data concerning natural persons being processed, the Municipality of Lacco Ameno informs of the following:
1 – Data Controller
The data controller is the Municipality of Lacco Ameno with headquarters in Piazza Santa Restituta. N.1 The Municipality of Lacco Ameno has appointed as Data Protection Officer (DPO) or Data Protection Officer (RPD)

2 – Purpose of processing
Personal data is collected for the purposes of the following procedures:
for the rental of berths at the Lacco Ameno Tourist Dock, in particular for the stipulation and execution of the rental contract with the related obligations. Personal data is processed for the aforementioned purposes.
3 – Processing methods
Data is processed in such a way as to guarantee security and confidentiality, using suitable paper, computer and telematic tools and means, adopting technical and administrative security measures aimed at reducing the risk of loss, incorrect use, unauthorized access, disclosure and tampering of the data.
4 – Legal basis for processing
necessity of processing for the purposes of stipulating and executing the contract, or for the purposes of executing pre-contractual measures adopted at the request of the interested party (art. 6 par. 1 lett. b GDPR);
necessity of processing to fulfill legal obligations to which the data controller is subject (art. 6 par. 1 lett. c GDPR); for example, fulfillment of legal, regulatory or contractual obligations, execution of orders of the judicial or administrative authority;
necessity of processing for the performance of a task of public interest or connected to the exercise of public powers with which the data controller is invested; in particular for the management of the public tender procedure aimed at selecting the contractor (art. 6 par. 1 lett. e GDPR).
5 – Data subject to processing
Personal data of natural persons subject to processing are: name and surname, place and date of birth, residence / address, tax code, email, telephone, identification document number. The special categories of personal data referred to in art. 9 par. 1 GDPR are not subject to processing.
The processing of personal data is based on the following legal bases:
6 – Communication and dissemination of data
Personal data are communicated, without the need for consent from the interested party, to the following subjects:
to the subjects appointed by the Municipality of Lacco Ameno as Managers as providers of services relating to the website, to the ordinary and certified mailbox.
to the treasurer of the Municipality for the accreditation of the fees due to the Manager;
to the Authority for the supervision of public contracts for works, services and supplies, pursuant to art. 1 paragraph 32 of Law no. 190/2012 for procurement contracts;
to the authorities responsible for inspection and fiscal and administrative verification activities;
to the judicial authority or judicial police, in the cases provided for by law;
to any other public or private entity in the cases provided for by Union or Italian State law.
The subjects indicated from sub 2) to sub 7) will process the data in their capacity as independent data controllers, and will provide independent information pursuant to the GDPR
The dissemination of the data is limited to the publication on the website of the Municipality of Lacco Ameno in the section “Transparent Administration”, of the data required by the legislation on Transparency and Anti-Corruption.
7 – Transfer of data
The Municipality of Lacco Ameno will not transfer personal data to third countries not belonging to the European Union.
8 – Data retention period
The Municipality of Lacco Ameno retains the personal data of the interested party for as long as it is necessary or permitted in light of the purposes for which the personal data were obtained.
The criteria used to determine the retention periods are based on:
duration of the contractual relationship;
legal obligations weighing on the data controller, with particular reference to the fiscal and tax area;
necessity or opportunity of retention, for the defense of the rights of the Municipality of Lacco Ameno;
general provisions on the subject of prescription of rights.
With reference to the Manager, personal data are retained for the entire duration of the procurement contract and for the subsequent ten years from the date of termination of the contractual relationship.
Personal data may be retained for a longer period, if it is necessary for a legitimate purpose, such as the defense, including judicial, of the rights of the Municipality of Lacco Ameno; in this case, personal data will be retained for as long as necessary to achieve this purpose.
9 – Rights of the interested party
The interested party has the rights specified in Articles 15 to 22 of the GDPR, indicated below:

right to restriction of processing – art. 18 GDPR
right to data portability – art. 20 GDPR
right to object – art. 21 GDPR
The interested party can exercise these rights by sending a request to the PEC of the Municipality of Lacco Ameno:
In the subject, the interested party must specify the right that he intends to exercise, for what purpose he knows or supposes that his data has been collected by the Municipality of Lacco Ameno and must attach, if the request does not come from a PEC mailbox registered to the interested party, his identity document.
10 – Right to complain
The interested party also has the right to lodge a complaint with the Privacy Guarantor, which can be reached on the website www.garanteprivacy.it.
11 – Source of data
Personal data are provided by the interested party. However, the Municipality of Lacco Ameno may acquire certain personal data also through consultation of public registers, or following communication by public authorities.
12 – Provision of data
The provision of personal data is required under current legislation, and is also necessary for the purposes of participation in the negotiated procedure and, where applicable, for the purposes of stipulating, managing and executing the contract. Refusal to provide the requested data will not allow participation in the negotiated procedure or assignment of the assignment, stipulating, managing and executing the contract, fulfilling the regulatory obligations imposed on the Municipality of Lacco Ameno.
13 – Inexistence of an automated decision-making process
The Municipality of Lacco Ameno does not adopt any automated process, including profiling as per art.22, paragraphs 1 and 4, GDPR.
